ANTIVIRAL PROTECTION PLAN
TERMS AND CONDITIONS – ANTIVIRAL PROTECTION PLAN
1. Introduction
The Antiviral Protection Plan has been formatted by HCC to offer a cost effective and simple way to protect you with antiviral medication.

The Antiviral Medication reserved under this plan is Tamiflu capsules (packed 10 x 75 mg) and is only suitable for Adults and Children weighing over 40Kgs.

2.Definitions
In these Terms and Conditions:

“PLAN HOLDER” means any person (including but not limited to everyone covered under the Plan) who agrees to subscribe to the Nationwide Healthcare Connections Limited Antiviral Protection Plan
“HCC” means Nationwide Healthcare Connections Limited or any subsidiary or related company
“SERVICES” means the services HCC is to supply in accordance with these Terms and Conditions
“FURTHER SERVICES” means the further services HCC may supply to you the Plan Holder
“TERMS AND CONDITIONS” means the standard terms and conditions set out in this document and any variation to these terms and conditions agreed in writing between you, as Plan Holder, and HCC

3.     Basis of the Sale
3.1  HCC will sell and you, as Plan Holder, will buy in accordance to the services described on the website and subject to these terms and conditions.
3.2  No variation of these terms and conditions shall be binding unless agreed in writing between authorised representatives of HCC and the Plan Holder.

4.Services
4.1    You, as Plan Holder, will subscribe to the Service on an annual basis and HCC will reserve the required medication for you for a period of 12 months.
4.2    HCC automatically operate a stock replenishment process under the Antiviral Protection Plan and the Plan Holder will be contacted by HCC to advise of renewal.
4.3    The Plan Holder may terminate the plan at any time during the 12 month period without incurring a penalty fee from HCC
4.4    HCC are free to release the Plan Holder’s reserved antiviral medication to others unless your Antiviral Protection Plan is renewed and paid for by you prior to expiry of each 12 month period
4.5    HCC guarantee to reserve the stock for which the Plan Holder subscribes and pays for in accordance with the Terms of Payment below.
4.6    The Plan Holder will subscribe for medication for themselves. Should the Plan Holder decide to offer the service to family and friends under the Plan Holders own plan, HCC will charge for the full annual cost involved and the Plan Holder will be responsible for collecting any subscription due in this respect.
4.7    HCC will store the reserved medication under climate controlled pharmaceutical conditions in secure facilities.
4.8    HCC will be responsible for all costs relating to storage and insurance for such reserved medication.
4.9  Under the Antiviral Protection Plan HCC is offering a reservation service only and therefore the title of all stock remains with HCC.  
4.10  HCC will only supply medication to the Plan Holder at such time as the Plan Holder calls down the reserved stock by way of electing and paying further charges to participate in the HCC full health scheme (see Further Services below).
4.11  The Service applies to the UK only.

5.Further Services Available
5.1    The Plan Holder will, in the event of a pandemic, be given the opportunity to participate in the HCC full health scheme This further service will only be offered to a Plan Holder whose annual subscription is fully paid. Additional fees for the full health scheme as shown on the website will apply.
5.2    Subject to prior receipt of payment, the HCC full health scheme may be delivered to the Plan Holder via secure online registration, with direct delivery service
5.3    Subject to the Plan Holder’s agreement, the Plan Holder’s family and friends may also be given the opportunity to participate in the HCC full health scheme.  The Plan Holder must pay for the family and friends inclusion directly to HCC upon registration to the scheme.
5.4    The HCC full health scheme procedure and terms will be provided to the Plan Holder if and when the Plan Holder elects to proceed with this further service

6.Pricing
6.1   The price of the services shall be the HCC quoted price on the website
6.2   HCC guarantee the annual renewal fee for the Service will remain the same for 2 years.
6.3   The price applied to the Service is per pack of medication/per annum.  One pack of medication consists 10 x 75 mg Oseltamivir (Tamiflu) capsules.  However this price reserves medication stock only. Final supply of medication is only by way of participating in the HCC full health scheme where further costs apply for services.

7. Terms of Payment
7.1The Service and Further Services will be paid for by the Plan Holder in advance via the HCC secure on line payment service prior to HCC supplying such Service and Further Services to the Plan Holder

8. Refund
8.1  No refund of the annual fee will be made to the Plan Holder under any circumstances in respect of the Antiviral Medication Plan.
8.2  Should the Plan Holder decide to participate in the full health scheme at any time during the 12 month contracted period, no refund or allowance will be made against the consequential further charges applicable for the further service to be provided

9. Liability
9.1  HCC shall not be liable in any way to the Plan Holder if the services are not performed in accordance with these terms and conditions due to force majeure.
9.2  HCC excludes all inability for any loss, damage or costs the Plan Holder may incur resulting from any act or omission of the Plan Holder.

10. General
10.1  In the event of a general company restructure amalgamation or takeover, where  no major change to service provision is to be made, all contracts (including those which are set out only within these terms and conditions) are automatically transferred to the new entity.
10.2  Joint and Several: The invalidity or unenforceability of any provision hereof shall not affect or impair the validity or enforceability of any other provision.  No waiver of any default of the Plan Holder shall be implied from any failure by HCC to take action with respect to such default.
10.3  Governing Law:  These terms and conditions shall be interpreted and enforced in accordance with the laws of England.
